Fischer Skis Settles Blind Customer’s Website Access Lawsuit

Fischer Skis US LLC has settled a lawsuit alleging it fails to make its website accessible to the visually impaired in violation of the Americans with Disabilities Act. The terms of the settlement are confidential, counsel for plaintiff Christopher Walters, Benjamin J. Sweet with Nye, Stirling, Hale and Miller LLP, told Bloomberg Law. The parties filed their notice of settlement Wednesday in the US District Court for the Northern District of New York. The court, in August, ruled that the case could go forward, finding the ADA accessibility law isn’t limited to businesses with a physical location…
Cell Phone Accessibility: Improving, but Gaps Remain, CACP Researchers Find

Cell phones are becoming more accessible, but gaps remain — including fewer features for people with cognitive disabilities, emerging issues such as vehicle connectivity, and surprising roadblocks such as poor battery life, according to the latest biennial analysis of cell phone accessibility by Georgia Tech’s Center for Advanced Communications Policy (CACP). “Not all cell phones are created equal as far as accessibility, especially when it comes to a specific disability,” said Research Scientist Salimah LaForce, who wrote the report (pdf) with CACP Research Associate Dara Bright…

Websites that violate disability laws squeezed for financial settlements

Andres Gomez is a serial litigant. That is, Gomez, who says he is legally blind, looks for websites that are not accessible to him and sues them for violating state and federal disability laws. By one estimate, the 34-year-old Miami man has filed more than 600 disability compliance lawsuits in Florida and California since 2015, sometimes famously. Gomez sued the Kardashians’ clothing stores, Dash, in 2016 and has gone after other big name fashion retailers, alleging their websites are incompatible with the screen reading software he uses to navigate the web, according to published reports…

Justice Department Finds Minnesota Department of Corrections Violates Rights of Incarcerated Individuals with Disabilities

On Sept. 30, 2022, the Justice Department found that the Minnesota Department of Corrections (MNDOC) violated the Americans with Disabilities Act (ADA) by denying incarcerated individuals with disabilities enrolled in its General Educational Development (GED) program opportunities to apply for and receive needed modifications on the GED exam. The MNDOC offers GED preparation courses and practice tests and administers the GED exam inside all of its adult prison facilities. The letter of findings asks the MNDOC to work with the department to resolve the civil rights violations identified during its investigation…
DOJ: $450,000 settlement a reminder that senior living communities must be accessible

A $450,000 settlement with an architectural firm that designs senior living communities should remind developers and architects of such properties that they must comply with federal laws that require the properties to be accessible for people with disabilities, the Justice Department said last week. The bathrooms, kitchens and other areas of six senior living communities, one senior apartment complex and one nursing home in Pennsylvania will be retrofitted to make them more accessible to those with disabilities under the terms of the settlement of a federal lawsuit against Riverton, NJ-based J. Justice Department Resolves Disability Discrimination Lawsuit Against Housing Authority of New Orleans Properties

The Department of Justice announced that the Housing Authority of New Orleans (HANO) and seven private developers have agreed to pay $250,000 to settle claims that they violated the Fair Housing Act (FHA) and the Americans with Disabilities Act (ADA) by failing to design and construct eight multifamily residential properties and associated places of public accommodation so that they are accessible to persons with disabilities. As part of the settlement, the defendants also agreed to make extensive retrofits to remove accessibility barriers at the properties…
Mental Health, SUD Orgs Fail to Offer ASL Language Accessibility Services

American Sign Language (ASL) interpreter services are hard to come by in mental health and substance use disorder treatment facilities, despite federal mandates to provide language accessibility services, according to new research in Health Affairs. Moreover, the process for reporting non-compliance is convoluted and rests with the patient, the researchers said, creating a patient engagement and access to care problem. “Not only are these patients at a two- to three-fold higher risk for mood and anxiety disorders, lifetime trauma exposure, and substance use than the general nondeaf population”, said Tyler G. Justice Department Finds Nevada Unnecessarily Segregates Children with Behavioral Health Disabilities in Institutions

The Department of Justice announced today that it has concluded an investigation into whether the State of Nevada subjects children with behavioral health disabilities to unnecessary institutionalization in violation of Title II of the Americans with Disabilities Act (ADA). The Justice Department determined that Nevada violates the ADA by failing to provide adequate community-based services to children with behavioral health disabilities, relying instead on segregated, institutional settings like hospitals and residential treatment facilities…
OTC Hearing Aids Increase Accessibility for Patients with Mild to Moderate Hearing Loss

Approximately 37.5 million Americans live with hearing loss. A pair of hearing aids can cost approximately $2,500 per device, totaling $5,000 for a pair of hearing aids––a cost rarely covered by insurance. Starting on October 17, 2022, OTC hearing aids will become available nationwide. These devices will only cost $500 to $1,000 per pair compared to traditional hearing aids. Lucas A. Most sidewalks in WA are not accessible

A report by the Seattle Times looked at the infrastructure of 30 Washington state jurisdictions. In all of those cities and counties, less than half of the roads and sidewalks complied with ADA standards. In 2020, Kenny Salvini was trying to map every street in Sumner. “My wife was pregnant with our daughter and we decided we’re going to roll every street in our little town,” says Salvini, who runs the Here and Now Project, whose mission is to connect and empower the paralysis community in the Pacific Northwest. Sask. farmer donates accessibility equipment to younger farmer with disability

Merle Malin came across the photo of a young farmer using a mobility assist purely by accident in a local newspaper. Once he saw Levi Jamieson, though, Malin knew he had a unique ability to help. Malin, a farmer from Redvers, is a paraplegic. For 18 years after his accident, Malin continued to work as a farmer using a hydraulic lift system to help him get in and out of his massive farming machinery. The lift mounts on a truck and helps lift people in wheelchairs to tractors or combines when they are working. Step-free access is needed for those who cannot use stairs, and this should be available from the front door all the way through the venue.
