Accessibility in the News—1/12/17
.
Credit unions are still wrestling with website accessibility cases, with a surge of suits hitting credit unions in December. Banks and hotels are also hearing calls for greater accessibility, and one plaintiff in New York is taking on well-known retailers, saying their sites are inaccessible to her screen reader software. In the meantime, Twitter users can make their tweeted images more meaningful to followers who have limited vision.

Beyond the Basics: How to Host a Truly Accessible Business Event
January 4, 2018 | Source: Eventbrite
At some point in their lifetime, 70% of all Americans will have a temporary or permanent disability. Many disabilities aren’t visible to the naked eye — mental illness, heart conditions, or deafness, for example. When you’re planning a business event, chances are, you’ll have registrants of different abilities. It’s definitely your job to know what ADA rules you must follow. But disability awareness extends beyond simply understanding the law. The more accessible your event, the more your attendees feel welcome — all of them…

More than 30 new ADA suits were filed against credit unions last month over the accessibility of their websites, likely making it a “December to remember” for many in the credit union industry. The surge brings the total number of suits filed to more than 60 so far. Credit unions in nine states have been served, according to court records. Sources tell CU Times that demand letters, which typically precede the suits, have landed on the doorsteps of even more credit unions…

January 6, 2018 | Source: BT.com & HuffPost & Bustle
A blind Twitter user who asked people on the social media platform to make a slight change to their settings to enrich his experience online has received an overwhelming response. Veteran Rob Long wrote a Twitter thread explaining how – and why – people should turn on a feature called “caption description”. The change won’t just benefit him but thousands of blind people who use Twitter with text-to-speech translators…

The U.S. District Court for the Eastern District of Virginia accepted an additional amicus brief submitted by NAFCU in support of a credit union’s motion to dismiss a complaint filed against the institution under the Americans with Disabilities Act. The Eastern District Court had previously accepted another amicus filed by NAFCU; the hearing for that case is today…
Local disability lawsuit part of broader battle
January 5, 2018 | Source: Bristol Herald Courier
A lawsuit filed Dec. 29 against Highlands Union Bank in U.S. District Court in Abingdon is one of many of its kind. Businesses across industries and the nation have faced threatened litigation and lawsuits related to website accessibility for people who are blind or visually impaired. Title III of the Americans with Disabilities Act [ADA], passed in 1990, outlaws discrimination based on disability with regard to the “full and equal enjoyment” of any place of public accommodation…
Getting Ahead of ADA Website Accessibility Lawsuits
January 6, 2018 | Source: IP Watchdog
I’m going to start this article in a way that most of you may find surprising. I want to thank Kylie Jenner. You see, for over a year now I have been telling clients, other lawyers, and family members (who politely nod because they still don’t quite understand what I do for a living) that companies need to make sure their websites are ADA compliant. This usually leads to a crass conversation about how a website can even be ADA compliant..

January 7, 2018 | Source: New York Post
A blind Manhattan woman recently filed individual lawsuits against more than 30 businesses she says are not handicap accessible online. Maria Mendizabal, who is legally blind, claims that the Web sites for companies such as Nike, 24 Hour Fitness, De Beers, Barney’s, Donna Karan, and Kleinfeld Bridal aren’t compatible with screen-reading software that translates the written content into either audio or Braille…

January 7, 2018 | Source: The Bellingham Herald
Don’t let concerns about accessibility keep you at home. Universal design has universal appeal for homeowners of all ages. New construction residences that utilize universal design concepts allow people to age-in-place, says Steve Soriano, executive vice president of Robson Resort Communities, based in Sun Lakes, Ariz. Robson Resort Communities include seven retirement developments featuring approximately 40,000 homes located throughout Arizona and Texas. “People are starting to think about where they want to live long term before they retire,” Soriano says…

A New Year for Online Businesses: DOJ Ends 2017 by Withdrawing Website Accessibility Rulemaking
January 8, 2018 | Source: JD Supra
2017 was a busy year for retailers and businesses with an online presence, as they faced a wave of demand letters and lawsuits alleging that their websites are inaccessible to the visually impaired and/or hearing impaired in violation of Title III of the Americans With Disabilities Act of 1990 (the “ADA”). As we have previously reported, courts across the country weighed in on the issue throughout the year. To bring an end to 2017, the Department of Justice (“DOJ”) withdrew its proposed rulemaking for accessible websites…

Federal Websites Failing to Meet Standards, Industry Leaders Weigh In
January 9, 2018 | Source: MeriTalk
Communication is key–especially for the Federal government. One of the most important ways the government communicates with citizens is through agency websites. In fact, the Federal government has roughly 4,500 websites on more than 400 domains. However, the vast majority of those websites aren’t meeting industry standards. In its recent report, the Information Technology & Innovation Foundation (ITIF) surveyed almost 500 of the most popular Federal websites to assess website performance in terms of page-load speed, mobile friendliness, security, and accessibility…
For People Living with Disabilities, New Products Prove Both Practical and Stylish
January 9, 2018 | Source: Smithsonian & Disability Scoop
When buying a pair of shoes, a pen, or a new car—the expectation is for the product to do the job. But you also want it to look good: stylish, current, cool. Why wouldn’t the same be true of products—wheelchairs, hearing aids, and more—designed to aid those with disabilities? This is one of the major questions explored in the new exhibition “Access+Ability,” on view at the Cooper Hewitt, Smithsonian Design Museum through September 3 of this year…
Feds say Texas illegally failed to educate students with disabilities
January 11, 2018 | Source: Texas Tribune
A U.S. Department of Education investigation concluded Thursday that Texas violated federal law by failing to ensure students with disabilities were properly evaluated and provided with an adequate public education. After interviews and monitoring visits with parents, school administrators and state officials, the federal investigation found that the Texas Education Agency effectively capped the statewide percentage of students who could receive special education services and incentivized some school districts to deny services to eligible students…

There are approximately 48.9 million Americans with some form of disability. PayThink Payment companies face service, compliance gaps for the visually impaired
January 11, 2018 | Source: Payments Source
The convenience of online payments can both enhance the customer experience and accelerate the payment cycle and cash flow. However, this win-win scenario breaks down if the consumer is unable to make use of the payment processing website — which may happen if they are blind or partially sighted and the website or the documents contained on it are not made accessible. The fact is that while 15% to 20% of the population needs websites and documents to be in accessible formats, only 3% to 4% of documents are actually made accessible…
How To Make Snow-Bound Cities Less Of A Frozen Hell For People With Disabilities
January 11, 2018 | Source: Fast Company
On Thursday, January 4, the eastern seaboard braced itself for what became known as the “Bomb Cyclone“–a winter storm promising heavy snowfall and lashing winds. New York City, staring down the prospect of a foot of snow, canceled school; municipal courts shut down. But when Kay Ulanday Barrett, a poet who relies on a cane to get around, called in to the Worker’s Compensation Board in the state to check if his meeting, scheduled for that day, was still happening, he was surprised to learn that it was…
Startup aims to make vision care more accessible in developing world
January 11, 2018 | Source: Phys.Org
Vision impairment is a major global issue. More than 2 billion people worldwide don’t have access to corrective lenses. Getting eyeglasses prescriptions is especially difficult in developing countries. Optometrists are generally located in urban centers and rarely see patients from rural areas, so many people suffer from uncorrected impairments. According to the World Health Organization, this can lead to impaired quality of life, learning difficulties, and lost employment opportunities and finances…

Learning from accessibility: ‘When we embrace inclusive design, everyone benefits’
January 3, 2018 | Source: The Guardian- UK
For Robin Christopherson, who is blind, getting cash out has traditionally been a socially uncomfortable and not entirely secure process. “Whenever I’m lining up at an ATM, I have to grab a person next to me and say to them: ‘Here’s my card, this is my pin, and this is how much I want,’” he says. “Luckily, I’ve never been ripped off as far as I’m aware, but it wouldn’t be hard.” The scenario will be familiar to thousands of banking customers with visual impairments or other accessibility challenges…

Why The Big Fitness Trend Of 2018 Should Be Accessibility
January 5, 2018 | Source: HuffPost- UK
The world of fitness can be incredibly intimidating. From the outside, it can appear to be an exclusive club of strict regimes, impossibly flat stomachs and tiny Lycra outfits, while fitness brands sport slogans like ‘elevators are for wimps’ and ‘what’s your excuse?’ This kind of language and imagery is especially widespread at this time of year, as companies scramble to cash in on our New Year’s resolutions. It is broadcast carelessly, without any thought for the damage that it could do for those who struggle to access fitness because of chronic illness or disability…

Passenger Assist offers dignified help for people with disabilities
January 8, 2018 | Source: The Sociable- UK

Laurier student with vision impairment advocating for accessibility and inclusion
January 10, 2018 | Source: Wilfrid Laurier University- Canada
It’s a dinner at which students often have trouble finding their forks – and when they do, sometimes they lift them to their mouths only to find there’s nothing on them. Dinner in the Dark can be an awkward and sometimes messy affair. But it’s not some kind of novelty or joke. At the event, hosted twice a year by the Wilfrid Laurier University club Eye to Eye, students eat blindfolded to gain a degree of understanding of what it’s like to have a visual impairment. The objective isn’t to inspire pity – far from it…

Shen, 18, is in his third year at Taipei School for the Visually Impaired, which partners with Microsoft to provide feedback on Narrator and other accessibility features of its operating system…
