Accessibility in the News — 3/31/2023.
The US Supreme Court has agreed to hear a case concerning the right of an ADA “tester” to sue hotels over a rule outlined in the American’s With Disabilities Act. The case was brought by Acheson Hotels, which owns a hotel in Maine and was sued by Deborah Laufer, who has filed hundreds of similar lawsuits against hotels across the US. Laufer claims that the hotels’ websites are not in compliance with ADA rules requiring disclosure of information on accessibility to individuals with disabilities. The court will determine whether Laufer has the right to act as a “tester” without visiting the hotels in question.

The US Supreme Court on Monday agreed to hear a case concerning whether a self-appointed “tester” of the Americans with Disabilities Act has the right to sue hotels over alleged violations of the civil rights law. The court was asked to take the case by Acheson Hotels, which owns and operates a hotel in coastal Maine. The company was sued by Deborah Laufer, who they say has filed hundreds of lawsuits against hotels across the country, claiming their websites are not in compliance with ADA rules that require hotels to disclosure information about how accessible they are to individuals with disabilities…

The eyes are more than a window to the soul — they’re also a reflection of a person’s cognitive health. “The eye is the window into the brain,” said ophthalmologist Dr. Christine Greer, director of medical education at the Institute for Neurodegenerative Diseases in Boca Raton, Florida. “You can see directly into the nervous system by looking into the back of the eye, toward the optic nerve and retina.” Research has been exploring how the eye may help in diagnosing Alzheimer’s disease before symptoms begin. The disease is well advanced by the time memory and behavior are affected…

Web Accessibility Laws Set To Enter New Era As DOJ Gears Up For Spring Rulemaking
March 24, 2023 | Source: Forbes
This May the U.S. Department of Justice’s Civil Rights Division will kickstart a rulemaking procedure some 13 years in the making aimed at codifying technical standards to assist public entities in complying with obligations to make their websites accessible to individuals with disabilities. The original rulemaking process began under the Obama administration back in 2010 but was then abandoned before being withdrawn in 2017. Within this legal vacuum, akin to not having building codes for accessibility in the physical world – inaccessible online public services and inconsistent judicial rulings on how the Americans with Disabilities Act should be applied to the internet…
‘Live free and die?’ The sad state of U.S. life expectancy
March 25, 2023 | Source: NPR
Just before Christmas, federal health officials confirmed life expectancy in America had dropped for a nearly unprecedented second year in a row – down to 76 years. While countries all over the world saw life expectancy rebound during the second year of the pandemic after the arrival of vaccines, the U.S. did not. Then, last week, more bad news: Maternal mortality in the U.S. reached a high in 2021. Also, a paper in the Journal of the American Medical Association found rising mortality rates among U.S. children and adolescents…
Disability activists fight for equality in the South

Disability rights activist Dom Kelly says he jokes that he and his triplet brothers started their advocacy work at the ripe age of 4 years old. “My mother put us in front of a room of high school seniors and said ‘tell your story, good luck,’” he says. From those early days in the classroom, he took a detour — to become a founding member of the rock band A Fragile Tomorrow. Today, he’s back to his roots, leading a new coalition that fights for disability justice across 14 states called New Disabled South…

Officials say Virginia must improve disability services for students
March 27, 2023 | Source: VPM
Federal officials continue to find the Virginia Department of Education out of compliance with multiple requirements outlined under the Individuals with Disabilities Education Act, which ensures students with disabilities are provided a “free appropriate public education.” In a February letter Valerie Williams, director of the federal Office of Special Education Programs, outlined several concerns to the department, including that “the State does not have procedures and practices that are reasonably designed to enable the State to exercise general supervision over all educational programs for children with disabilities administered within the state.”…
Executive with Disabilities Shares Her Story
March 27, 2023 | Source: SHRM
While workers with disabilities are landing jobs at record rates, they continue to deal with unique challenges, such as physical barriers and social stigmas associated with their condition, that can make work more difficult. In March 2022, federal data revealed that employees with a disability were more than twice as likely as those with no disability to have requested a change in their workplace to better perform their job—such as asking for new or modified equipment or changes in work tasks or schedule. But these requests aren’t always fulfilled…

Disability rights activist Judith “Judy” Heumann passed away on March 4, 2023, at age 75. Widely regarded as the mother of the disability rights movement, Ms. Heumann played an instrumental role in developing and implementing multiple groundbreaking pieces of legislation, including the Americans with Disabilities Act, or ADA. Disability Is Always Someone Else’s Problem
March 29, 2023 | Source: The Nation
In the United States, children with severe disabilities, especially intellectual disabilities, face an ignominious juncture around age 20. Aging out of school is referred to as “the cliff,” as students go abruptly from the structure and services provided in school into… nothingness as adults. During our son’s last Individual Education Plan (special needs) meeting, we argued for funding for his Covid makeup year (an additional year offered to some special needs students turning 21 in New York)…

Northwest is still working to catch accessibility regulations

Within these, many standards were set on facilities to ensure the accessibility for those with disabilities…

Disability Inclusion in the Workplace
March 30, 2023 | Source: Darren Bates LLC
In recent years, the corporate world has made some strides in recognizing the value and potential of disabled employees. But the question remains: are companies committed to creating inclusive and accessible workplaces or just paying lip service? Despite the growing recognition of the need for disability inclusion, there is a noticeable gap between the accolades that companies receive and the meaningful actions they take. While many companies are quick to tout their diverse hiring practices and high scores on disability equality indexes, disabled employees often still face systemic barriers and discrimination in the workplace…

With apologies to David Lettermen, here is my list of “Ten Things” I wish all airline passengers and employees understood about wheelchair-using passengers…
Addressing Disability
March 30, 2023 | Source: Harvard Magazine
During a panel discussion Wednesday evening at the Harvard Kennedy School (HKS), politicians and educators came together to discuss why disabilities remain relatively ignored in classrooms and unnoticed in public policy. Throughout the evening, the panelists returned to the question of “value.” To what lengths must we go to show that people with disabilities provide great contributions to the world? How can we demonstrate that creating a more accessible world for people with disabilities benefits people of all ability levels? And must we prove the societal value of people with disabilities in order for them to gain respect?…

A new online resource aims to increase accessibility across the film industry
March 24, 2023 | Source: Little White Lies- UK
Part of the great joy of cinema is that it seemingly has no limits – great films have the capacity to transport us to entirely different worlds, challenge our perceptions, and show us something we’ve never seen before. As such, this world of possibilities has the potential to strike a chord with anyone, no matter their identity or background. Cinema is, in short, for everyone. Unfortunately that’s not quite the reality, and there are still huge barriers to accessing film for many, including geography, finances, and consideration of how disability impacts the film-viewing experiences…

As Ukraine marked a year since Russia’s full-scale invasion, Sasha Kharitonov spent his days lying in a bed in a corner of a small room that smelled of cigarettes and had Russian TV playing in the background. He’s 17 years old but unable to move or eat on his own because of a severe form of cerebral palsy. He has frequent seizures and sometimes struggles to breathe. Sasha requires round-the-clock care, but after his mother died three months ago no one was willing to take care of him. ‘An inherent indignity’: the fight to get workers with disability a living wage

They are people who really can’t do anything,” Shawn Tarwater, a state representative in Kansas told a state house committee last month as he argued to protect a scheme that allows companies to pay people with disabilities as little as $3 an hour. “If you do away with programs like that, they will rot at home. There is no place for them to go.” The comments have sparked a storm of protests from disability advocates and highlighted a system of state tax credits across the US that allows employers to pay people with disabilities significantly less than the federal minimum wage…
