Five years after the lawsuit was first filed, federal district court judge Jesus Bernal ruled on June 23 that Domino’s had violated Title III of the Americans with Disabilities Act (ADA) by having a website that was not fully accessible to plaintiff, who is blind. This litigation saga has involved an appeal to the Ninth Circuit by plaintiff which reversed the district court’s dismissal of the case, a petition for certiorari filed by Domino’s which was denied, and numerous skirmishes in district court on remand which eventually culminated in the court’s June 23 order granting plaintiff’s motion for summary judgment on the ADA claim as it relates to Domino’s website…

County decades behind on ADA compliance at parks
June 27, 2021 | Source: Hawaii Tribune-Herald
Almost a quarter-century after Big Island resident Alexa Russell sued Hawaii County to enforce Americans With Disabilities Act mandates in county parks, only six of the 16 facilities the county agreed to upgrade have been done, and the County Council will be asked to float $25.5 million in bonds to pay for the rest. Russell filed the suit in federal court in 1997. She and the county settled the case in 1998, and the parties have been holding regular status conferences ever since…
How accessible is transit in New York?
June 27, 2021 | Source: City & State
Every New Yorker knows what it’s like to be exasperated with train delays or miss a muffled announcement from a subway conductor that a local train is suddenly going express. Unreliable transit service is reliably annoying. But for people with disabilities trying to navigate New York City and its surrounding neighborhoods, those annoyances become real impediments. The city has services available and work underway to make transportation more accessible, but those services don’t function perfectly…
‘Honor those spots:’ new rules coming on who can park in handicap accessible spots
June 27, 2021 | Source: WOAI
A new state law will change the rules for who can park in handicap accessible spots. It’s a change Anne Robinson and others have been fighting for since 2017 and now it is almost here. “Those handicap parking spots, they’re our independence,” said Robinson. She was injured 21 years ago while active duty in the military. Robinson uses a van with a ramp to get around town. Because it has a ramp she needs the extra space around her vehicle that only a handicap accessible spot provides. But finding a spot is often difficult…

‘People think they’re more accessible than they are’: IR’s role in accessibility for aging shareholders
June 29, 2021 | Source: IR Magazine
No one in IR sets out to alienate or insult shareholders. But that’s what can happen when investor communications fall short of accessibility standards and companies compound the problem in their dealings with shareholders who have disabilities. Jill Houghton, president and CEO of Disability:IN, tells of one case that illustrates how quickly a lack of awareness can damage or terminate an investor relationship. It began with what should have been a straightforward accessibility request by a shareholder with a hearing impairment…
What To Know Before You Judge Someone For Using A Disability Accessible Parking Spot
June 29, 2021 | Source: HuffPost
“Handicap, handiCRAP!” we heard someone shout. I cringed, and my muscles tightened as I felt the relaxation of our vacation day slip away. My husband and I glanced at one another and confirmed our mutual frustration at the situation. My young family of five was on a road trip and just had a much-needed day off from traveling. Someone must have seen two non-disabled adults get into the van and assumed we were misusing the space. We looked to see if the person who shouted was still around…

Disabled and Low Income People Need Affordable Internet, But Access Is Limited
June 29, 2021 | Source: Medium
It was in March 2020, during the first few weeks of the shut-downs due to the COVID-19 pandemic, that my internet started to constantly crash. My broadband connection, which had always been decent if not top-notch, began to slow to a crawl. This tended to happen during the most inconvenient times — when I was on the phone with a doctor or interviewing someone on Zoom for an article I was writing. I assumed perhaps that the problem was the surge of people working from home now and using their internet…

About 15 per cent of the world’s population lives with some form of disability, according to the World Health Organisation, yet fashion and beauty can be hard to enjoy because of attitudinal barriers, says Samantha Renke, a presenter, disability activist and ambassador for disability charity Scope…

My plea to the prime minister: disabled people also need safe and accessible homes
June 25, 2021 | Source: Inside Housing- UK

This focus was welcome news for many people as we pass the fourth anniversary of the tragic events at Grenfell Tower, and disabled people will be watching keenly for implementation of new rules designed to keep them safe in their homes. But in last month’s Queen’s Speech, while there were announcements on planning, leaseholding and renting, there was a resounding absence of substantial policy relevant to disability and accessible housing…

Microassist Digital Accessibility Services
Have you received an accessibility demand letter because of your website or application? Please contact us for any questions you have about our accessibility services and how we might support your organization.
Services include:
- Accessible Website and Application Development— We rely heavily on accessibility best practices and using HTML5 and ARIA (Accessible Rich Internet Applications) standards to build WCAG-compliant and human-tested accessible environments. Our teams are proficient in open source technologies such as WordPress, Drupal and Moodle, as well as custom frameworks in .NET, PHP, AngularJS, and other frameworks. Our Learning and Development team can also help you create accessible custom training.
- Accessible Document Services— Whether you’re dealing with a few or a warehouse of Microsoft Office documents, PDFs, or other files, there are several ways Microassist can enable your team to offer documents and materials that meet stringent accessibility standards.
- Accessibility Remediation— Our accessibility remediation services help you fix existing materials so that they conform to WCAG, Section 504 and 508, Department of Education OCR, and ADA Title II/III requirements. We remediate websites, applications, documents, and elearning, recommending re-creation when that is more efficient and economical. Especially for website and applications, to find out what is in need of remediation, we’ll start with an Accessibility Audit.
- Accessibility Training— With several courses available for developers, testers, and content creators, your team can become equipped to consistently and expertly produce accessible digital products and online environments.
- VPAT®Evaluation Services— Primarily used by government purchasers and government vendors during the procurement and sale of ICT products and services under Section 508, a Voluntary Product Accessibility Template® (VPAT) attests to the accessibility of a given product or service. Contact us to make sure the VPAT you write or review is accurate and meaningful.
