Accessibility in the News — 7/28/2023.
The Justice Department has proposed a new rule under the Americans with Disabilities Act (ADA) to improve accessibility for people with disabilities to web and mobile apps and clarify ADA obligations for public entities, particularly state and local governments, as more of their activities shift online. This rule is crucial, especially in light of the increased reliance on web and mobile apps for essential services during the pandemic. The proposed rule aims to ensure that people with disabilities can access vital public programs and services, such as employment and education resources, voting information, health and emergency services, and transit schedules. It is the first time the Justice Department has issued a proposed rule on website accessibility under the ADA, signifying a significant milestone in advancing accessibility in the digital sphere.

For more than three decades, the Americans with Disabilities Act (ADA) has been a driving force in moving America closer to the promise of equal opportunity, full participation, independent living, and economic self-sufficiency for the 61 million individuals with disabilities in our country. Because of the ADA and its protections against discrimination in public accommodations, employment, transportation, and community living, millions of people with disabilities have grown up with the promise of the same rights and chances as their peers without disabilities — and our communities, our economy, and our country are all stronger as a result…

The report by Detroit Disability Power and The Carter Center audited 261 polling places across 15 jurisdictions in Southeast Michigan during last year’s midterm elections, finding that 84% of the polling places appeared out of compliance with accessibility requirements. The report looked for accommodations including an accessible parking area with a clear pathway into the building, an accessible entrance into the building, a fully accessible voter assist terminal, and an accessible booth for casting paper ballots privately…
The imperative for accessibility in advanced air mobility
July 20, 2023 | Source: Vertical Magazine
The Americans with Disabilities Act (ADA) has made definite improvements for accessibility in public buildings, buses, trains and subways, and we comply with these in our design work every day. The Air Carrier Access Act (ACAA), on the other hand, has not done as much to improve travel accessibility for those who need it. Operators say it’s too hard and too expensive, and they have a point. It is a challenge, but challenges need to be addressed with clarity, focus and creativity…
How to make cannabis websites ADA compliant
July 20, 2023 | Source: MJBizDaily
For people with disabilities, being able to navigate a website is just as important as the accessibility to buildings that’s required under the Americans with Disabilities Act (ADA). Signed into law more than 30 years ago, the ADA eliminates discrimination against people with disabilities in all public places, including office buildings, public transportation, schools and any other public place. While there isn’t a law that specifically calls for company websites to comply with the (ADA), the expectation has developed over time in case law…

A few passed the stop at South Carrollton Avenue and Sycamore Place on April 30 without an ADA-compliant lift…

Casey Holds Hearing on Affordable, Accessible Housing for Older Adults and People With Disabilities
July 20, 2023 | Source: Senator Bob Casey
Despite a sizeable elderly and disabled population in the U.S., there is not enough affordable housing to accommodate those individuals. “For millions of Americans, adequate housing is more of an aspiration than a reality,” said Sen. Bob Casey, D-Pa., who serves as chairman of the Senate Special Committee on Aging, at a Thursday hearing. “In particular, too many older adults and people with disabilities cannot afford accessible housing,” Casey said.
About 26% of the U.S. population — or about 61 million people — have a disability, Casey said. At the same time, 1 in 5 Americans will be older than 65 by 2030…

But the sudden, rapid expansion of telehealth means patients generally can now text or email their health care providers. “When you wanted to get a Zoom visit or an audio visit, you needed to sign up for the patient portal, and I think a lot of people became aware that they could message for the first time” during the pandemic, says A Jay Holmgren, a researcher in health care information technology at the University of California San Francisco…

Border restrictions may no longer be a hindrance for travelers post-pandemic, but other challenges still plague people with disabilities. Americans with mobility disabilities spend US$58.2 billion a year on travel. However, 96 per cent said they faced problems with accommodation, while 86 per cent experienced issues with flights, according to a survey of more than 2,000 people conducted by research firm MMGY Travel Intelligence…

A U.S. District Court in Mississippi temporarily blocked a voting law in the state Tuesday that was set to go into effect July 1. The law, known as Senate Bill 2358, creates new restrictions for who can assist someone while voting by mail. Voting rights and disability rights advocates, who filed the lawsuit, argue Mississippi’s law violates a federal protection that allows a voter to choose who helps them cast a ballot. In his order striking down the law, U.S. District Court Judge Henry Wingate wrote, “voting polls are expected to extend outstretched hands of welcome and provide unfettered access to conscientious citizens.”…

How Many Disabled People Vote Over the Internet? We Need Better Data
July 26, 2023 | Source: Center for Democracy and Technology
Policy decisions around voting technology have a huge impact on the security, fairness, and accessibility of elections. These decisions must be made from a fully informed perspective, particularly when the outcomes may disproportionately impact marginalized communities. One of the thorniest decisions in election administration is who—if anyone—should be able to vote over the internet. To better inform this decision, the U.S. Election Assistance Commission (EAC) should collect data on the availability of internet voting options to people with disabilities and on how many disabled voters take advantage of these options…

The majority of people who are getting access to programming is white disabled people.” While less than 4% of U.S. housing units could be considered livable by people with moderate mobility disabilities, Black and Latinx people with disabilities, especially the aging population, tend to have an even more difficult time finding housing suited to their accessibility needs…

It was his priority during his two terms, but as a polio survivor left with his own mobility problems, it had begun back in the 1990s. Onley, who died earlier this year, spoke of his frustration over the lack of progress being made to improve accessibility for Ontarians with disabilities, outlined in a review of the Accessibility for Ontarians with Disabilities Act, which he wrote for the government in 2019. The legislation had been passed in 2005…

Department for Transport figures show Ashfield had 643 licensed vehicles as of April, but only 88 could be used by people with mobility difficulties, down from 92 in March 2020. Traditional taxis can be hailed from the street and do not need to be pre-booked like private hire vehicles, such as those used by companies like Uber…

It was something that seemed extra important to me, given art isn’t always something that has felt accessible to me as a working-class disabled person…

Microassist Digital Accessibility Services
Have you received an accessibility demand letter because of your website or application? Please contact us for any questions you have about our accessibility services and how we might support your organization.
Services include:
- Accessible Website and Application Development— We rely heavily on accessibility best practices and using HTML5 and ARIA (Accessible Rich Internet Applications) standards to build WCAG-compliant and human-tested accessible environments. Our teams are proficient in open source technologies such as WordPress, Drupal and Moodle, as well as custom frameworks in .NET, PHP, AngularJS, and other frameworks. Our Learning and Development team can also help you create accessible custom training.
- Accessible Document Services— Whether you’re dealing with a few or a warehouse of Microsoft Office documents, PDFs, or other files, there are several ways Microassist can enable your team to offer documents and materials that meet stringent accessibility standards.
- Accessibility Remediation— Our accessibility remediation services help you fix existing materials so that they conform to WCAG, Section 504 and 508, Department of Education OCR, and ADA Title II/III requirements. We remediate websites, applications, documents, and elearning, recommending re-creation when that is more efficient and economical. Especially for website and applications, to find out what is in need of remediation, we’ll start with an Accessibility Audit.
- Accessibility Training— With several courses available for developers, testers, and content creators, your team can become equipped to consistently and expertly produce accessible digital products and online environments.
- VPAT®Evaluation Services— Primarily used by government purchasers and government vendors during the procurement and sale of ICT products and services under Section 508, a Voluntary Product Accessibility Template® (VPAT) attests to the accessibility of a given product or service. Contact us to make sure the VPAT you write or review is accurate and meaningful.
