The Justice Department sued the state of Colorado today for unnecessarily segregating adults with physical disabilities, including older adults, in nursing facilities in violation of the Americans with Disabilities Act (ADA) and the U.S. Supreme Court’s decision in Olmstead v. L.C. The department previously notified Colorado of its findings of civil rights violations in a March 2022 letter to Colorado Governor Polis. EEOC Sues Union Pacific Railroad For Disability Discrimination

Union Pacific Railroad, a freight-hauling railroad headquartered in Omaha, Nebraska that operates rail lines in 23 states, covering most of the western two-thirds of the United States, violated federal law when it terminated conductors and locomotive engineers on the basis of perceived disability, used unlawful qualification standards to screen out individuals with disabilities, and subjected the employees to unlawful medical examinations and inquiries, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed today…
Hotel Website’s Supreme Court Case Could Shake Up How Disability Law Is Enforced

The Supreme Court is hearing oral arguments on Wednesday in a major case that could affect disabled individuals’ rights to sue a place of public accommodation for failing to provide accessibility information on its website. The case, Acheson Hotels LLC v. Laufer, came about after the plaintiff, Deborah Laufer, a disabled Florida resident, filed a lawsuit in 2020 against Acheson Hotels LLC, a hotel operator based in Maine, alleging that one of its hotels did not have sufficient information available about the establishment’s accessibility features on its website or reservation system…
Attorney General Bonta Joins Multistate Coalition Supporting U.S. DOJ’s Proposal to Adopt Specific Accessibility Requirements Online for People with Disabilities

Gardening benefits both our physical and mental health. But for people who are older or have a disability, the prospect of kneeling or bending over to tend to a garden can sound daunting. New College of Florida said Thursday it settled with the U.S. Department of Education’s Office of Civil Rights over allegations it was discriminating against people with disabilities. In September, OCR began investigating the public liberal arts institution for failing to make its website and social media accounts equally accessible to all users. College leaders said they would correct the issues over the next eight months, but did not give further details on how they would comply with federal disability standards…

Immigrating to Northern California 40 years ago, the Villasenor Family has shared a taste of Mexico through their restaurants. Their children now run Villa Corona Restaurant locations in Vacaville, Napa and St. Helena. But now they are accused of discriminating. “I was shocked,” Carlos Villasenor said. A vision-impaired customer named Jesus Torres filed a lawsuit in Contra Costa County court claiming the restaurant’s website has “accessibility barriers for blind or visually impaired people.” The lawsuit claims it kept him from ordering food online…

Judge rejects Loudoun School Board member’s disability discrimination suit

A federal judge has dismissed a discrimination lawsuit filed by a Loudoun County School Board member against the board, saying her efforts to compel the board to allow her to participate in meetings virtually lacked legal standing. Denise Corbo (At Large) filed the lawsuit in June, alleging that the School Board had failed to accommodate her disability. Corbo, who was elected to the board in 2019, has multiple physical impairments, according to the complaint, including chronic Lyme disease and autoimmune diseases “that substantially limit her major life activities,” including her ability to attend board meetings…

India Sims’ favorite place in Charlottesville is 5th Street Station, the large shopping area anchored by Wegmans supermarket. It’s one of the few places in town where her presence feels expected rather than just tolerated. Voters File Lawsuit Challenging Alabama Absentee Ballot Accessibility in Federal Court

On Tuesday, Oct. 3, four voters who are blind or have a print disability and the National Federation of the Blind of Alabama filed a lawsuit against absentee election managers for Tuscaloosa, Mobile and Jefferson counties challenging Alabama’s inaccessible absentee voting system. North Dakota state parks making fall colors more accessible to colorblind people

As fall colors begin their annual show across the state’s hills and valley, North Dakota Parks and Recreation is launching an initiative to make those colors available to people with color blindness. Supermarkets Aren’t Accessible Enough, Here’s What’s Missing
