Fagnani argues Bradford Exchange ultimately denies full and equal access to its website to individuals who are blind or visually impaired in an alleged violation of the Americans with Disabilities Act (ADA). “Defendant deprives blind and visually-impaired individuals the benefits of its online goods, content and services—all benefits it affords nondisabled individuals,” the Bradford Exchange class action states. The Bradford Exchange website contains access barriers that make it not compatible with screen-reading programs used by individuals who are blind or visually impaired to browse the internet, the Bradford Exchange class action alleges…

December 22, 2022 | Source: Department of Justice
The Justice Department announced today it filed a complaint and proposed consent decree with the U.S. District Court for the Northern District of Ohio to resolve allegations that the Ohio Department of Rehabilitation and Correction (ODRC) violated Title I of the Americans with Disabilities Act (ADA). Boston becomes latest city to require closed captions on public TVs
December 22, 2022 | Source: The Washington Post
Boston has become the latest city to require many businesses to activate closed captioning on all their televisions in public spaces, making communication more accessible to people with hearing loss, one of the most common physical impairments in the United States. The statute, approved this month, requires restaurants, gyms, banks and other businesses to keep the captions on during normal business hours. A member of Boston’s disability board raised the issue in 2020 after realizing that critical information about the covid-19 pandemic was not fully accessible to people with hearing disabilities, the city said…
Iowan with dementia speaks of winter dangers: “my brain doesn’t tell me cold and hot”
December 23, 2022 | Source: KGAN
These strong winds and freezing temperatures can be deadly and that risk is even greater in people with dementia and Alzheimer’s disease. So the first year was tough,” said Kevin Dill, a West Des Moines resident. Dill has been living with lewy body dementia since 2019. “Didn’t feel needed or wanted anymore and didn’t know where to turn or what to do as we struggled,” said Dill. Dill is one of more than 66,000 Iowans living with the disease, which can be hard and confusing to navigate…

December 23, 2022 | Source: House Beautiful
Creative design for the disabled community shouldn’t just stop at entry point access. It can seep into every aspect of a home—and be luxurious, too. From open floor concepts to roll-in showers and indoor elevators, luxury home design can be inclusive with just a bit of forethought, say designers Alexa Vaughn, Deaf landscape designer and accessibility specialist at the Los Angeles-based MIG, and Dala Al-Fuwaires, principal designer at House of Form in Scottsdale, Arizona…
Lyft Likely Facing Class Claims in Wheelchair Accessibility Suit
December 23, 2022 | Source: Bloomberg Law
Lyft, Inc. looks unlikely to defeat a bid for class status over claims that it discriminates against people with disabilities by failing to consistently or reliably provide wheelchair accessible vehicles to would-be riders, based on a magistrate judge’s recommended ruling. US Magistrate Judge Andrew E. Krause recommended class certification in a report to Judge Philip M. Halpern of the US District Court for the Southern District of New York, Thursday. Krause suggested limiting the claims in the lawsuit, after agreeing with some of Lyft’s challenges to the plaintiffs’ standing. Krause recommended dismissing claims for regions where Lyft offers wheelchair accessible …
In 2023, Brands Need To Grasp The Full Diversity Of Web Accessibility Needs
December 23, 2022 | Source: Forbes
For far too long, and certainly, for the uninitiated, the important issue of website accessibility has been viewed as something related to blind users above anybody else. When reflecting as to why this may be the case – there is no singular reason but instead, a multiplicity of factors at play. For a start, though sight loss is a spectrum and can be driven by a variety of medical conditions, it remains a fairly linear and consistent disability for non-disabled web designers to, for want of a better word, envisage…
For visually impaired art fans, Philly museum’s scent-based exhibit ‘leveled the playing field’
December 26, 2022 | Source: Billy Penn
When Denice Brown was invited to tour the immersive olfactory exhibit at the Institute of Contemporary Art, she imagined an encounter of familiar smells of Philadelphia. “I thought about all the odors I normally smell as I’m walking through the city,” said the 64-year-old North Philadelphia native, who is visually impaired. “A garden, or green peppers and onions from a restaurant.” Some city smells aren’t so great, Brown acknowledged, “like when someone has urinated in an elevator.” But she still didn’t expect what happened with the work titled “Fear.”…

December 26, 2022 | Source: KEVN
Christmas is here and many of us have unwrapped our presents. However, if you’re looking for another gift, South Dakota Game, Fish, and Parks has something you can give any time of the year, access to the outdoors. And with two all-terrain wheelchairs, that gift is a lot more approachable. “You feel the ground beneath the tracks,” said Becky Noble as she sat in the Outdoor Campus West Action Track Chair. “You feel like you’re part of the outdoors among the trees and the wild and it’s an amazing freedom.”…

December 27, 2022 | Source: UPMC and Daily Beast and Mint Lounge and Revyuh
A group of neuroscientists led by a University of Pittsburgh School of Medicine researcher developed a test to detect a novel marker of Alzheimer’s disease neurodegeneration in a blood sample. A study on their results was published today in Brain. The biomarker, called “brain-derived tau,” or BD-tau, outperforms current blood diagnostic tests used to detect Alzheimer’s-related neurodegeneration clinically. It is specific to Alzheimer’s disease and correlates well with Alzheimer’s neurodegeneration biomarkers in the cerebrospinal fluid (CSF)…
Creed 3 Making Sure Disability Accessibility Is A Key Part Of The Film
December 27, 2022 | Source: Game Rant
Creed 3 is making sure that accessibility for the disabled is a core part of its message. The sequel promises to make Adonis Creed’s (Michael B. Jordan) daughter’s, Amara (Mila Davis-Ken), experience as a Deaf child a simple fact of life for her character. Amara was born in Creed 2 to Adonis and Bianca (Tessa Thompson), Adonis’ love interest and motivation, as Talia Shire’s Adrian was to Rocky. Bianca is a musician with progressive hearing loss, and she is dismayed to learn her daughter is Deaf at birth, believing that this means the two will not be able to bond over her deep love of music…
Closing the accessibility gap with accessibility-first transit systems
December 27, 2022 | Source: Mass Transit
COVID-19 has spurred such enormous technological advancements that make it almost unimaginable to return to the way we lived and operated in pre-pandemic times. People are now benefiting from the after effects of digitization in a number of ways that have simplified things from the way they had previously done them. For example, the travel industry has seen a surge in online trip planning and ticketing, which improves the overall experience for travelers. While advancements have been made, the transportation industry is still behind on addressing the expanding effects of the accessibility gap in public transit…

‘Not Just the Ramp.’ Worship Spaces Need More Accessibility
December 29, 2022 | Source: U.S. News and World Report
Jerry Lamb could not maneuver his wheelchair into the rows of pews at his church. It wouldn’t fit. Nor could he sit in the aisles without awkwardly blocking the way. So he adapted. It’s a regular part of his new life with limited mobility that requires near-constant calculations of how to navigate a world no longer set up for him. That included his longtime church in Camden, Tennessee – one of the many U.S. houses of worship with accessibility limitations…

Sanyia, however, is still stuck 1,800 miles away from home without her luggage, any toiletries or her cochlear implant charger. Bryce Dallas Howard is quietly normalizing a little-known accessibility standard on social media. For the past seven months, the actress has been using alternative text on her Instagram photo posts—and it’s something we can totally get behind! When you scroll the 41-year-old’s Instagram page, you immediately notice that Howard creates alternative text for all of her image posts. If you don’t know about alt text, it’s a great way for visually impaired users to receive a description of the photo you’ve posted…
Hydration can significantly impact your physical health, study finds
January 2, 2023 | Source: CNN
You may know that being adequately hydrated is important for day-to-day bodily functions such as regulating temperature and maintaining skin health. But drinking enough water is also associated with a significantly lower risk of developing chronic diseases, a lower risk of dying early or lower risk of being biologically older than your chronological age, according to a National Institutes of Health study published Monday in the journal eBioMedicine. “The results suggest that proper hydration may slow down aging and prolong a disease-free life,” said study author Natalia Dmitrieva…
‘Until it affects you’: Wheelchair users still battle to make NJ more accessible
January 3, 2023 Source: app.
Stanley Soden of Long Branch was heading down Lowden Court to pick up groceries for himself and two neighbors in his apartment building. Despite the sidewalks that line Monmouth Medical Center on his right, Soden, who uses a motorized wheelchair, was riding on the street next to cars and trucks. The reason? For Soden, sidewalks can be less safe than streets. At a few curb cuts leading down the sidewalk along Lowden Court, puddles and potholes have the ability to tip his wheelchair. That is one of the many barriers wheelchair users face to fully participating in the communities where they live…
Airlines Need To Figure Out How To Take Care Of Wheelchairs — Now
January 3, 2023 | Source: HUFFPOST
I hate flying. Well, that’s not completely true. I don’t mind the actual flight; I just dread all the things that could go wrong between buying a ticket and getting to my destination. Here’s how it usually goes: I wave goodbye to my wheelchair at the door of the airplane as I’m transferred into a special aisle chair because standard wheelchairs don’t fit through the narrow aisles. I am then unceremoniously dragged through the plane on the aisle chair by the airport assistance crew. Contrary to what many believe, wheelchair users are often boarded last, so every other passenger is able to look on as I am helped to my seat…

Addressing accessibility should not be an afterthought in the Metaverse
December 24, 2022 | Source: The Toronto Star- Canada
A few months ago, I attended a summit on virtual innovation where the topic of discussion was the rapid pace of technological transformation taking place across large swaths of society. Not surprisingly, the metaverse was a hot topic. It is predicted that the metaverse could be a $8-trillion (U.S.) to $13-trillion industry with five billion users by 2030, according to a March 2022 report by U.S. investment bank Citi, able to connect us anytime, anywhere. The metaverse will offer users immersive 3D experiences they otherwise wouldn’t be able to experience in real life…

For people with disabilities in the country, the compact four-wheeled, two-seat vehicle has become the primary form of micromobility—a term encompassing a range of small, lightweight vehicles typically operating at around 15 miles per hour. The Canta looks a bit like a little Fiat or Mini and has all the main features of a car: engine, drivetrain, roof, windows, and doors…

Simple blood test developed to detect Alzheimer’s in potential gamechanger for early detection
December 28, 2022 | Source: Daily Mail- UK
Scientists have devised a way to detect signs of Alzheimer’s disease through a simple, inexpensive, blood test. The new blood-based test developed by a cadre of scientists from the UK, the US, Sweden, and Italy paves the way for cheap and easy diagnostics that could help millions of Americans begin treatment for the disease in very early stages. To diagnose Alzheimer’s, scientists look for three distinct markers of the disease: an abnormal buildup of plaques in the brain as well as neurodegeneration, the gradual process in which nerve cells lose function and die…

December 28, 2022 | Source: CTV- Canada
Marla Smith and her service dog Kuno like to spend time doing things around the city, so she’s not very happy about being left at Rogers Place last Friday with no ride. “I booked for a 6 p.m. cab to get us for the 7 p.m. game and I booked for a 10:15 p.m. pickup and they did advise it could be up to 40 minutes after that,” she explained. Despite being a few minutes late to the game, the drop-off worked out well. But the pick up proved disastrous. Smith, her friend and Kuno were all left waiting for hours. So they called the taxi-line…

Every day is busy and filled with new challenges for Charlene O’Reilly of Seaforth, Ont. O’Reilly sits on two boards in the county which oversee hospitals in the area, along with improving the region’s accessibility for those with both physical and invisible disabilities. Playfully referring to herself as a “CEO of three,” O’Reilly holds these titles with great pride while battling her own struggles with Multiple Sclerosis — a chronic disease affecting the brain and spinal cord — for about a decade…

After an ill-fated stunt left him paralysed, the “British Evel Knievel” said his rich and fulfilling life as a disabled person has taught him to “always have hope”. As a child growing up in Canonbury in the 1960s, Eddie Kidd could not have known the highs and lows that would come to define his life. His parents moved to the borough after his father left the army. A student at Newington Green Primary School and later Highbury Grove School for Boys, Mr Kidd went on to become a celebrated stuntman, working on multiple Bond movies and other films including Bullseye! and Hanover Street before a serious crash in 1996 left him paralysed…
