KVUE dumps closed captioning firm after slur during bombing coverage
March 22, 2018 | Sourse: Statesman
Austin ABC affiliate KVUE says it has severed ties with the closed captioning firm it had been using after one of the Austin bombing victims was referred to on air Tuesday night using a racial slur. The station said it would have made the move sooner, but needed to be sure it followed Federal Communications Commission guidelines. A local TV station says an “unacceptable” typographical error made by a third-party closed captioning firm resulted in one of the Austin bombing victims being referred to on air this week using a racial slur…
New Rule Lets Civil Rights Office Ignore Cases From Serial Complainers
March 22, 2018 | Source: Education Week
The U.S. Department of Education’s office for civil rights has started dismissing hundreds of disability-related complaints, following new guidelines that say such cases will be dismissed when they represent a pattern of complaints against multiple recipients. The office enforces laws such the Americans with Disabilities Act and Section 504 of the Rehabilitation Act of 1973, both of which prohibit public entities from discriminating against individuals based on disability. It also enforces Title IX, which prohibits discrimination based on sex, and other laws that prohibit discrimination based on age, race, color, or national origin…

March 22, 2018 | Source: 9to5Mac & All Sources
Apple has today proposed a new set of emoji to the Unicode Consortium that focuses on accessibility. The new set includes at least nine new emoji. As reported by Emojipedia in a blog post: New emojis proposed include a guide dog, hearing aid, prosthetic limbs, as well as people using canes and different types of wheelchairs. Emojipedia notes the opening remarks of Apple’s submission: Apple is requesting the addition of emoji to better represent individuals with disabilities. Currently, emoji provide a wide range of options, but may not represent the experiences of those with disabilities…
M&A Diligence Checklist: Don’t Forget Website and App Accessibility
March 23, 2018 | Source: Fredrikson & Byron PA
Buying a non-accessible website may buy you a class action lawsuit. Website accessibility/Americans with Disabilities Act (ADA) lawsuits, including class action claims, continue to flourish in state and federal courts. The lawsuits target website and app owners and operators of all sizes, large and small, across industries including: retail, banking & finance, health/medical, travel, hospitality, restaurants, auto and education. A typical complaint alleges that because a particular website is not designed to work well with electronic screen reader technology, it discriminates against blind potential-users in violation of the ADA…
Doctors inject lab-grown genes into boy’s eyes to treat blindness
March 24, 2018 | Source: Mashable
On the morning of March 20, eye surgeon Jason Comander injected viruses carrying lab-grown genes into the eyes of a boy whose vision had been gradually disappearing. If all goes as planned, the 13-year-old patient — who lives with an inherited genetic defect that causes blindness — will experience an improvement in eyesight in about a month. After a series of tests, the U.S. Food and Drug Administration (FDA) approved this gene-therapy treatment, called Luxturna, in December 2017…
Linn County Democratic convention model for accessibility
March 24, 2018 | Source: The Gazette
In its effort to make participation in the political process possible for more Iowans, the Linn County Democratic Party’s convention Saturday was the most accessible so far. Not only was it held at a location compliant with the American with Disabilities Act — the Kirkwood Community College Linn County Regional Center in Hiawatha — but several other steps were taken to address accessibility, said Catherine Crist of Cedar Rapids, chairwoman of the party’s Disability Caucus…
Why is it getting harder to find handicapped parking in NJ?
March 26, 2018 | Source: NorthJersey.com
Scott Chesney just needed a few things from Walgreens. But with snow plowed into the store’s only two handicapped-accessible spaces, the Verona resident, who is paralyzed and uses a wheelchair, had nowhere to park. This was not an isolated incident, said Chesney. He and other advocates say parking for individuals with disabilities is becoming increasingly scarce, making everyday tasks like buying groceries, grabbing a sandwich from the deli or picking up dry cleaning a constant battle…
ADA Lawsuits: Are Major Changes Coming?
March 26, 2018 | Source: JD Supra
When Congress passed the Americans with Disabilities Act, or the ADA as it is routinely referred to, in 1990 it probably could not have envisioned the sheer number of lawsuits that would be filed under the ADA in the ensuing years. While there have been some ebbs and flows in the volume of such filings over the years, ADA lawsuits, nevertheless, have, by and large, abounded and continue to do so to the present day. The rules of engagement with respect to ADA lawsuits may have begun to change, however, on February 15, 2018 when the United States House of Representatives passed H.R. 620, the ADA Education and Reform Act of 2017…

March 28, 2018 | Source: CUinsight.com
Credit Union National Association and the League of Southeastern Credit Unions and Affiliates today filed another amicus brief in the U.S. District Court for the Southern District of Alabama defending Naheola Credit Union, which was hit with a lawsuit alleging violations of the Americans with Disabilities Act (ADA). “CUNA and LSCU continue our aggressive defense of credit unions as they continue to see predatory law firms seek to exploit unclear standards required for website accessibility,” said CUNA President/CEO Jim Nussle…

March 27, 2018 | Source: Legal Newsline
A class action lawsuit on behalf of Queens, N.Y., resident Eugene Duncan and other visually impaired plaintiffs against Popular North America Inc. is one of 43 recent Americans with Disabilities Act cases filed on his behalf. All of these cases were filed between Jan. 21 and Feb. 21 against defendants such as First Republic Bank, East West Bancorp, First Central Savings Bank, and a range of other financial businesses. The complaint filed Jan. 29 in the U.S. District Court for the Eastern District of New York against Popular North America shows plaintiff’s attorneys Joseph Mizrahi and Jeffrey and Dana Gottlieb asking for jury trial…
Accessibility in the Workplace: Considerations for IT Professionals
March 27, 2018 | Source: CIO Review
The importance of ensuring accessible technology in the workplace cannot be underestimated. Accessible technology refers to technology that can be used by individuals with various disabilities, including visual, hearing, mobility and cognitive. Many workplaces are ill-equipped to cater to individuals with both physical and mental disabilities, meaning that the rate of unemployment amongst individuals with disabilities is high: for example, the U.S. Bureau of Labor Statistics reports that as of 2016, fewer than 18 percent of individuals with disabilities are employed, versus over 65 percentage of non-disabled individuals…
Even Internet Entrepreneurs Need to Make Their Businesses Handicap Accessible
March 27, 2018 | Source: Entrepreneur
As entrepreneurs move from idea to action, they often start by creating a website. And why not? The internet provides access to billions of people and potential customers. However, while the access is incredible, entrepreneurs often ignore the principle of accessibility and fail to take the required steps to ensure that people with disabilities are able to use their business’s website. Just like every pot has a lid, every problem has a plaintiff. In 2017, plaintiffs filed at least 814 website access lawsuits, including a number of class action filings…
Captions for Accessibility is Imperative- Why Subtitles Would Be a Benefit for the Deaf Community
March 27, 2018 | Source: The Banner Newspaper
Captions have been an underappreciated and neglected form of disability assistance in the United States. For those who don’t know what it means to have accessibility to caption use, it is a vastly important tool for members of our community who are deaf or hard of hearing. It allows such people to watch any form of visual display with subtitles (words) to help them understand audio. The use of captions for television, computers and mobile devices are important enough for people of the deaf community to be knowledgeable of what is going on in our society…
Tech Leaders Gather at CSUN Conference to Advance Inclusion, Accessibility
March 27, 2018 | Source: CSUN Today
The exhibit hall at the CSUN Assistive Technology Conference featured a treasure trove of devices and software that help people with disabilities navigate — and fully experience — the world. There were apps that audibly describe the surrounding world for people with impaired vision, phones that display scrolling captions of conversations for people with hearing loss, and spoons with stabilizing handles for individuals with hand tremors. One wearable video camera, BrainPort V100, connected to an oral electrode array that stimulated shapes and patterns on the user’s tongue, essentially painting pictures for the visually impaired wearer to imagine…
How smartglasses help the blind see; conference spotlights assistive technologies
March 27, 2018 | Source: San Diego Union Tribune
Lex Gillette, the long jump world record holder for para-athletes, stopped in the lobby of Manchester Grand Hyatt last week and asked Erin for a list of nearby restaurants. She read off choices and then helped guide Gillette to a bistro – even though Erin was miles away from the downtown San Diego hotel. Erin is an agent for Aira (pronounced eye-ra,) a local start-up exhibiting at the 33rd annual Cal State University Northridge (CSUN) Assistive Technology Conference here last week. Gillette, 33, lost his sight when he was 8. He wore Aira smartglasses with an embedded camera so Erin could view his surroundings…
Is Your Online Job Application Accessible To The Visually Impaired? The Newest Website Accessibility Claims
March 28, 2018 | Source: National Law Review
In recent years, businesses have been inundated with a wave of serial litigation wherein private plaintiffs have argued that websites that are insufficiently compatible with screen reading software are in violation of Title III of the Americans with Disabilities Act (“ADA”). The typical allegation in such cases is that the plaintiff could not read the website and, as a result, could not access the goods and services offered by the company. These private plaintiffs have taken advantage of the current ambiguity in the law to bring multiple lawsuits…
The Disability Community Is Being Excluded From the Gun Control Conversation
March 28, 2018 | Source: Teen Vogue
Hundreds of thousands of people attended March for Our Lives events across the U.S. — and the world — on Saturday, calling for gun control reform with a focus on stopping school shootings. One group of people struggled to attend those marches, though: the disability community, which reported widespread problems with accessibility and inclusion at numerous marches in the U.S. Some disabled people were unable to attend at all, while others dealt with access issues that made it difficult to participate, and marches had signage depicting people identified as disablist and exclusionary…

Adhiambo Mitchell lost both his legs in a car accident on the Belt Parkway in Brooklyn almost 10 years ago. Nolan Ryan Trowe was partly paralyzed while cliff diving in Northern California in 2016. When they met last year, they bonded over a shared attitude toward their disabilities. “It’s very affirming to be around someone as positive as Adhiambo,” Mr. Trowe said. “I have never heard him complain about anything.” “Nolan is adventurous,” Mr. Mitchell said. “You can put him in any predicament and he’ll know how to maneuver. There is no cowardice in him. And he is a really good rapper.”…
Clyde making changes to parks after ADA complaint
March 28, 2018 | Source: Fremont News Messenger
John and Jan Brewer first raised concerns about accessibility to Clyde’s parks and playgrounds in 2011. After years of prodding city officials for changes, the Brewers turned to the federal government in 2017 for answers and filed an Americans with Disabilities Act complaint with the U.S. Department of the Interior’s Civil Rights Division. The city has responded with a transition plan that will address several of the ADA concerns raised by the Brewers. “Finally all our parks and playgrounds will be fully accessible to ALL members of ALL families,” John Brewer said in an email to the News-Messenger…
Employment Posters and Policies – Is There A Duty To Translate?
March 28, 2018 | Source: National Law Review
When setting workplace expectations, proactive employers should recognize the varying levels of literacy and English fluency in today’s workforce, as well as the need for employment information to be accessible to individuals with disabilities. Plain English policies, which are clear to the average reader, are important. But is there a duty to translate key employment documents or information? Under federal law, there are at least three instances in which an employer may be required to provide notices in a language other than English…
Managing the New Online Reverse Mortgage Advertising Landscape
March 28, 2018 | Source: Reverse Mortgage Daily
While word of mouth is often touted as the best source of reverse mortgage business, originators large and small agree that advertising is also a necessity — particularly among a target demographic that is increasingly consuming information online. But as the number of consumers getting financial product information online increases, so too does the scrutiny around online advertising materials. With several federal and state agencies monitoring and enforcing advertising law, there are several compliance issues that have recently become more prevalent that reverse mortgage companies need to observe…
Off the Map
March 28, 2018 | Source: Jacobin Magazine
In rankings of the US’s best urban public transportation systems, Washington, D.C., San Francisco, Boston, and New York usually hover at the top. At the bottom are smaller and poorer cities like Buffalo, Cleveland, Omaha, and Oklahoma City. The overall takeaway is no surprise: well-resourced cities have better public transit systems than their more economically distressed counterparts. For people with physical disabilities, this poses a dilemma. Because many disabilities preclude walking long distances and/or driving, access to public transport is critical for many disabled people to get around…
Disability advocates urge Cuomo to make NYC’s transit more accessible
March 29, 2018 | Source: Metro
With overcrowded trains, near-daily signal issues causing delays and that looming L train shutdown, being a straphanger in New York City is no easy feat. But while many can often use alternatives like walking, getting off at another train station, riding a bike or taking a car, that is not the case for the thousands of New Yorkers with mobility issues. And that’s why disability rights advocates are urging Gov. Andrew Cuomo to support MTA funding that repairs and modernizes its aged transit system while also making accessibility and paratransit improvements for those residents a priority…
Jack Fact — The Conference Board of Canada, there are 2.9 million Canadians living with a physical disability that impairs their mobility, vision, or hearing, representing 10 per cent of the country’s population and that number will rise by 1.8 per cent annually over the next 13 years, nearly double the pace of the population as a whole.

With just 3% of India’s buildings accessible, our disabled are at a huge disadvantage
March 23, 2018 | Source: Hindustan Times- India
Celebrated British physicist Stephen Hawking, who died recently, once said: “People with disabilities are vulnerable because of the many barriers they face: attitudinal, physical, and financial. Addressing these barriers is within our reach…..But most important, addressing these barriers will unlock the potential of so many people with so much to contribute to the world.” Hawking’s call for action is something which will fall by the wayside here given the indifference created by red tape and government agencies…
Journalist criticises airport for treatment of disabled passengers
March 24, 2018 | Source: BBC- UK
BBC journalist Frank Gardner has criticised Heathrow Airport for how it treats disabled passengers after being kept nearly two hours on a plane as staff said they had lost his wheelchair. When he landed on Saturday morning on a flight, Gardner’s wheelchair was taken to the terminal, rather than the plane door, leaving him stranded. He said: “That is your legs gone. It is a basic human right.” A Heathrow spokesman apologised and said it would investigate. Gardner landed at the London airport after returning from a trip to Ethiopia to be told ground staff had “lost” his wheelchair…
Accessibility renos to legislature please Man in Motion, Rick Hansen
March 24, 2018 | Source: Winnipeg Free Press- Canada
Rick Hansen couldn’t even get into the Manitoba Legislative Building during his Man in Motion tour in 1987, but Friday, he settled smoothly into Premier Brian Pallister’s place on the government front bench. Not so long ago, you’d have to go down a few steps to get to that seat. However, Hansen said this wasn’t about getting his wheelchair anywhere he wanted to go on the floor of the chamber, it was about any disabled child knowing he or she can become premier, a cabinet minister, a backbencher, the Speaker or a member of the clerk’s staff…

Thanks to RightHear free app, people who are blind or visually impaired can navigate independently in public spaces such as universities, hospitals, airports and shopping malls, and even call for a local assistant if needed…
States back anti-discrimination legislation to support disabled
March 23, 2018 | Source: Jersey Evening Post- UK
As part of a five-year project to update the Island’s discrimination laws, Social Security Minister Susie Pinel brought forward proposals which set in law the accessibility requirements required in buildings to support disabled Islanders. It marked the final stage of discrimination legislation after race discrimination laws were put forward in 2013, followed by sex and age discrimination in 2014 and 2015 respectively. Deputy Pinel said: ‘It is important to appreciate that all of us are likely to be affected by disability at some point in our lives, be it personally, a family member, a friend or a colleague.’…
Cape Breton business owners told accessibility makes economic sense
March 23, 2018 | Source: Cape Breton Post- Canada
Making Nova Scotia more accessible is not only good for those with disabilities but it makes solid economic sense as well, according to the head of Nova Scotia’s Accessibility Directorate. “What a lot of people don’t realize in Nova Scotia is that 20 per cent of our population has a disability,” Gerry Post explained to a group of business owners at a meeting on Friday. “We’re the highest in Canada and it’s growing. (Statistics Canada) project it to be 31 per cent by 2026.” Post was in Sydney to explain why Cape Breton business owners should take advantage of the new Small Business ACCESS-Ability Program launched last December…
Brad McCannell: A barrier to people with disabilities is a barrier to making a profit
March 23, 2018 | Source: Vancouver Sun
A recent research report from the Conference Board of Canada has made a powerful business case for improving accessibility in the built environment. People with disabilities already represent 14 per cent of consumer spending, or $164 billion annually. By 2030, real spending by this group is anticipated to grow to 21 per cent of the total consumer market, or $316 billion annually. At the same time, there is a lack of meaningful access in Canadian workplaces resulting in chronic unemployment in the disability community…
Making Jordan accessible for wheelchair users
March 25, 2018 | Source: The Arab Weekly- Jordan
Roundabouts in Amman ease the flow of traffic but there are noticeable problems of access across the city. Mobility problems are likely to be worse for people with disabilities. If difficulties are felt by able-bodied people, “imagine how impossible it is to get around for wheelchair users,” said Aya Aghabi, who uses a wheelchair following a life-changing accident in 2009 that led her to recast her thinking. Motivated by the lack of accessibility and resources in Jordan to aid wheelchair users, Aghabi founded Accessible Jordan, an online platform that catalogues wheelchair-friendly spaces around the country…
Celebrating 100 years of making the world more accessible
March 25, 2018 | Source: TB News Watch- Canada
For 100 years, a nation-wide organization has been helping make communities across the country more accessible to those who experience the world a little differently. The Canadian Institute for the Blind (CNIB) celebrated 100 years of serving people with vision loss during a local ceremony on Saturday. “You only turn 100 once,” said Tanis Boardman, program lead for peer support and advocacy with the CNIB. “It’s also an opportunity to recognize community members who are blind and partially sighted out in our community and getting involved and the volunteers who dedicate many hours of their time to this organization.”…

On a chilly March weekend in Seoul, disabled and non-disabled performers from the U.K’s Candoco Dance Company examined individual struggles and triumphs, and the transformational potential of unity. As they danced onstage, members of the audience were breaking their own barriers and together seeing performance in a new light. Assisted by Relúmĭno, Samsung’s vision-enhancing app, people with visual impairments were able to see the finer details, taking in the movements and the facial expressions of a live performance, many for the first time…
The Accessibility Act: Improving life for people with disabilities
March 27, 2018 | Source: Open Access Government- EU
There are over 70 million people with disabilities in the European Union. With an ever-increasing ageing population, this number will go up. Due to low birth rates and rising life expectancy, the proportion of older people is also increasing rapidly. Within the coming 40 years, the number of people over the age of 65 will almost double, from 17.4% to 30%. Just like every EU citizen, elderly people and people with disabilities need full access to all aspects of life. In practice, however, this is not the case…
Accessibility for all is not an option – it’s a fundamental right
March 28, 2017 | Source: Open Access Government- EU
The European Commission’s recently published Progress Report on the European Disability Strategy 2010-2020 shows that the European Union is on the right track. Ten years ago, the UN Convention on the Rights of Persons with Disabilities was adopted and ever since, the rights of people with disabilities have been gradually reinforced in all EU Member States. The rights of EU citizens have also been strengthened in cross-border situations. The 2011 Directive on the application of patients’ rights in cross border healthcare has facilitated the access to medical care for people with disabilities…
Disability doesn’t mean you can’t enjoy Israel
March 28, 2018 | Source: Canadian Jewish News- Israel
A visit to Israel had been on our minds for a long time. My husband, Brian, had dreamed of visiting our homeland, but since his diagnosis of progressive multiple sclerosis (MS) five years ago, the idea was daunting. As a slow walker with a myriad of symptoms, he knew that typical organized tours would be too fast for us. Like many baby boomers, he had kept his desire to go on the back burner, only to realize that things weren’t getting any easier. My two sons – Jonah, 23, and Brandon, 17 – had also never been to Israel, and had no plans to participate in the Birthright Israel program…
How SMEs can gear their website for visually impaired users
March 29, 2018 | Source: My Business- Australia
One in five Australians are living with a disability. This includes 357,000 individuals who are blind or visually impaired. Like most Australians, they rely on the internet to find information, goods, services, and employment. Head of design, user research and user experience at SEEK, Cameron Rogers, said that as the internet becomes an intrinsic part of our daily life, websites optimised for people with disabilities are no longer optional, but a necessity. To remain competitive, SMEs must ensure that visually impaired Australians – potential customers or highly-skilled employees – are not locked out of digital life,” he said…
The European Accessibility Act
March 28, 2018 | Source: Inclusive Publishing- EU
The European Accessibility Act has the potential to make the European internal market more inclusive and accessible for 80 million persons with disabilities. In December 2015, the Commission released a proposal for a European Accessibility Act, which is now at its final stage of negotiations. Many aspects of the proposed Directive have been challenged by users, industry, and governments, but ebooks remain one of the items in which, thankfully, there is a broad consensus…
