Low Vision Expert Admitted in ADA Discrimination Case

A federal district court in Louisiana recently heard a motion to exclude expert testimony of a Certified Low Vision Therapist in an ADA (Americans with Disabilities Act) action. The plaintiff was a medical review nurse hired for the defendant insurance company. In July 2013, she suffered a stroke. As a result, she experienced, among other things, a specific kind of partial vision loss called right homonymous hemianopsia that left the right side of her field of vision completely void.
Paralympic snowboarder designs innovative gear–for rivals

Adaptive snowboarder Mike Schultz could very well have the winning formula at the Paralympics — whether or not he even crosses the finish line in first. He is the architect behind some of the most cutting edge prosthetic components out there, which is no surprise considering he’s been tinkering with technology and testing it himself since losing his left leg above the knee a decade ago following a snowmobile accident. With demand for greater accessibility, Northwestern staff, students aim to close institutional gaps

Accessibility does not rank highly on Northwestern students’ list of priorities. In one section of Associated Student Government’s most recent annual analytics survey, Northwestern students were asked to allocate points among 16 prompts, said Austin Gardner, ASG’s vice president for accessibility and inclusion. Of the options, increasing funding for AccessibleNU ranked 14th on average, Gardner said. According to a January report by the Northwestern Accessibility Council, 2 percent of students registered with AccessibleNU during Fiscal Year 2016 were blind or visually impaired…
The current state of ADA compliance litigation and the credit union industry

As of the beginning of March 2018, there have been a lot of new developments with regard to ADA compliance and credit unions. Full disclosure, I am not a lawyer. So this should not be construed as legal advice, however, here’s the high level of the state of ADA litigation, as summarized at the recent CUNA Governmental Affairs Conference in Washington D.C. at the end of February, 2018. Credit Unions in multiple states have been heavily targeted for demand letters, a practice that seems to be picking up speed since the beginning of 2017, with 99% of them coming from one law firm in California…

Winonan Roxy Kohner has purple hair and no time for beating around the bush. Outside a downtown cafe last week, Kohner took the stairs with one hand on the railing and the other on her cane. “I’m fortunate,” she said. “I can choose because I can still walk.” Kohner is one of many Winonans with limited mobility, and like others, she had praise for what’s working, frustrations with what’s not, and suggestions for how Winona could be more accessible. “It’s pretty good,” Peter Flick said of accessibility in Winona. “It could be better, but it’s pretty good. 1-800-Flowers.Com Sued In Website Accessibility Lawsuit

Recently, a federal district court in the Commonwealth of Massachusetts refused to dismiss a website accessibility lawsuit against 1-800-Flowers.com brought under Title III of the Americans with Disabilities Act (“ADA”) by Access Now on behalf of three plaintiffs who are legally blind. The plaintiffs sued in the United States District Court for the District of Massachusetts (1:17-cv-10273-IT) and alleged that the blind and visually impaired were denied equal access to sixteen (16) websites owned or operated by 1-800-Flowers.com…
SOCSD rolls out new website

The Starkville-Oktibbeha Consolidated School District unveiled its new website last week after working on the project since December. The project was initiated following the district’s past website being found to not be compliant with the Americans with Disabilities Act (ADA), and the new website makes several subtle changes toward compliance, as well as other features added for convenience and general updates. The total cost of the redesign was approximately $18,000, with the next two years costing approximately $12,500. The total will drop to $10,200 in the third year…
Program Bringing Capital Metro Bus Information To People Who Are Blind Or Visually Impaired In Austin

MTA sued for renovating subway station without disabled access

The U.S. government sued the MTA and NYC Transit Authority on Tuesday for renovating a Bronx subway station without making it accessible to the disabled. In suing the agencies, the U.S. Attorney in Manhattan joined a lawsuit from the Bronx Independent Living Services, backing its complaint that the Middletown Rd. station on the No. 6 line lacked elevators when it was closed for an expensive renovation. “There is no justification for public entities to ignore the requirements of the (Americans With Disabilities Act) 28 years after its passage,” U.S. Attorney Geoffrey Berman said…
Lyft Sued for Discriminating Against Wheelchair-Users

Today, Disability Rights Advocates (DRA) filed a major class action lawsuit against Lyft, challenging the popular ride-sharing service’s failure to make wheelchair-accessible vehicles available in the Bay Area through its rideshare service. The suit, brought by a coalition of a disability rights group and individuals in the San Francisco Bay Area, is the first legal challenge to Lyft’s wheelchair-inaccessibility on its home turf. The plaintiffs—Independent Living Resource Center of San Francisco and two individuals who use wheelchairs—brought this action to end Lyft’s discriminatory practices and policies….

For disability rights advocate Haben Girma, it was about knowing there was chocolate cake in the university cafeteria. As a deafblind student at Lewis and Clark College, Girma said cafeteria workers often forgot to e-mail her the day’s menu, putting an unnecessary barrier between her and what she wanted to eat that day. Despite recent victories, credit unions’ ADA battle is far from over

Credit unions have seen a string of victories so far in 2018 with regard to lawsuits alleging violations of the Americans with Disabilities Act on CU websites. UK government commits to making buses accessible for wheelchair users

The UK government has committed to introducing safe, on-board wheelchair spaces that are easily accessible on buses. This follows a Supreme Court judgment in 2017 that concerned the ‘reasonable adjustments’ that bus operators should provide for passengers in wheelchairs. Trudeau Liberals axe funding for blind and vision-impaired books

Liberals vow to renew $2.5M in funding for blind and vision-impaired books

ANZ introduces accessibility features on its Visa Debit cards

ANZ has launched a new Visa Debit card with accessibility features to make banking easier for customers with a disability. Redesigned Visa Debit cards will feature bigger fonts, a notch that helps customers identify the correct way to insert a card into an ATM and EFTPOS machine, as well as raised dots indicating the right way up. ‘It packs like concrete’: Crushed gravel key to wheelchair access in river valley

Skytrain will make lifts ‘more accessible’ to disabled

The Bangkok Mass Transit System, operator of the skytrain, on Tuesday promised to make facilities for the disabled more accessible following Sunday’s rage attack on a locked glass elevator door at Asoke BTS station by a wheelchair-bound rights activist. Anat Arbhabirama, chairman of BTSC advisory board, said the disabled man, Mr Manit Intharapim, had refused to sign a form to use an elevator at Asoke BTS station, which was a required normal procedure. Public buildings in Tamil Nadu to be made PwD-friendly

Government Responds To Inquiry On Disabled Access And Built Environment

The government has said it would not be considering a review into the possibility of using tax exemptions, and specifically VAT exemptions for the installation of specific physical features to improve accessibility for disabled people.
