ADA Website Accessibility Lawsuits on the Rise: Companies Should Review Their Potential Exposure
April 20, 2018 | Source: Blank Rome
With the recent spike in website accessibility lawsuits, companies should review their websites for compliance with the Americans with Disabilities Act (“ADA”) in order to avoid litigation and should consider taking steps to remediate their websites to ensure people with disabilities have equal access to consumer-facing content. During the last year, there has been a substantial rise in lawsuits filed against many consumer-facing websites alleging violations of Title III of the ADA…
Cracks in Montclair State’s Disability Accessibility
April 19, 2018 | Source: The Montclarion
For some students, going to class involves basic, fairly easy steps. They walk or drive to school or class, attempt to avoid traffic, find parking, take the elevator or stairs then get to class and sit. However, the story is different for students with disabilities or injuries. It may take them more time to get around campus and navigate around simple things like cracks in sidewalks can impede their movement. Though Montclair State University officials have made headway in ensuring that their students with disabilities can move around comfortably, there is still room for improvement…

At core, accessibility means providing the same opportunities to everyone, including, for example, people with disabilities, children, women who are pregnant, and the elderly, in using technologies and products without inconveniences. Samsung’ developers apply various technologies to ensure accessibility, by listening closely to the feedback of those with disabilities…

The bold gait of Austin Seraphin
April 20, 2018 | Source: Technical.ly & Generocity
Every now and then, during our conversation, developer Austin Seraphin’s eyes hurt so much he contorts slightly in his chair and clenches his fists. But Seraphin, a 41-year-old accessibility consultant who’s been blind since birth due to a condition called retinopathy of prematurity, is combining Western medicine with herbal remedies to cope with the excruciating pain that his calcifying corneas are causing him. “I’ve been doing the drops and ointments and just, you know… keeping going,” Seraphin said…
DeVos DOE Begins Dismissing Civil Rights Cases in Name of Efficiency
April 20, 2018 | Source: NY Times & Independent Recorder & ABA Journal
The Education Department’s Office for Civil Rights has begun dismissing hundreds of civil rights complaints under a new protocol that allows investigators to disregard cases that are part of serial filings or that they consider burdensome to the office. Department officials said the new policy targeted advocates who flooded the office with thousands of complaints for similar violations, jamming its investigation pipeline with cases that could be resolved without exhausting staff and resources…
Polling place accessibility problems dragging on for too long
April 21, 2018 | Source: Idaho Press-Tribune
Voting is the highest duty and greatest responsibility we have as citizens. It is indeed a shame that so many people don’t vote. For the most part, voting is incredibly easy. It’s relatively easy to find out where you’re supposed to vote. Polls are open for 12 hours, from 8 a.m. to 8 p.m., so it should be easy enough to pop in on your way to work, on a lunch break or on your way home from work. It’s so easy, many of us don’t even have to think twice about it…
Access Navigators helps people with mobility issues
April 21, 2018 | Source: Seacoastonline.com
Todd Hanson went with his family to four different downtown restaurants before finding a place to eat that he could access with his wheelchair. That was a few years ago, and moments like that inspired Hanson, 59, who has primary lateral sclerosis, to create a website that shows people with mobility challenges what restaurants are accessible. Today, the nonprofit Access Navigators offers a website with maps of restaurants and attractions in Portsmouth, Stratham, Exeter, & Hampton listing details about accessibility, from door sizes to table heights to the closest handicap parking…
Texas Disability Group Wants Victims’ Voices Heard In Gun Debate
April 20, 2018 | Source: NPR
A disability rights group in Texas sent out a survey last month, trying to figure out how many of its members became disabled by gun violence. The group, ADAPT of Texas, says it’s an effort to collect data that will help inform Texas lawmakers about how they should legislate guns. Bob Kafka, an organizer with ADAPT, says when gun violence occurs, particularly mass shootings, the public tends to have a pretty limited discussion about what happens to the victims. Susan Nelson was one of those victims. About 25 years ago, she was having dinner at a friend’s house. Her friend had a gun…

Businesses need to ensure they are compliant with the Americans with Disabilities Act
April 22, 2018 | Source: Houston Business Journal
Businesses with an online presence could soon become targets of a burgeoning trend of disability discrimination claims under the Americans with Disabilities Act. Title III of the ADA prohibits discrimination on the basis of one’s disability in the full and equal enjoyment of the goods, services and facilities of any place of public accommodation. Most businesses must ensure their establishments do not have accessibility barriers preventing disabled individuals from having equal access to the businesses’ offerings…
Disabled People Don’t Belong In Music Venues, Apparently
April 23, 2018 | Source: Huffington Post
I used to see live music at least once a week, where I’d bathe in the colorful glow of stage lights while bass rattled my heart inside my ribcage. There is something transformative and healing about music ― you can almost reach out and touch it. As a music lover, I scan Coachella’s lineup every year. The Coachella Valley Music and Arts Festival is held every spring in Indio, California. The list of musicians gets more and more incredible each year, and 2018 is no exception: Beyoncé, Chromeo, Flatbush Zombies, Hayley Kiyoko, Ibeyi…
Wheelchair-accessibility mandate for car services advances
April 23, 2018 | Source: Crain’s New York Business
The city’s plan for more wheelchair-accessible car service took a step forward Friday, when a group dropped its legal fight against it. Arguing that the Taxi and Limousine Commission was overstepping its authority in setting accessibility requirements—and that their businesses would be devastated—black-car and livery operators had sought an injunction mto block the rules. On Wednesday U.S. district court Judge John Koeltl denied the motion, writing that it did not meet the two requirements for a preliminary injunction…
The Next Wave Of ADA Title III Litigation In Florida – Hotel Reservation Systems
April 24, 2018 | Source: JD Supra
Just a few months ago, I was posting about ADA Title III web site accessibility lawsuits and making your web site accessible for the visually impaired. Now, the Plaintiffs’ Bar has moved on to the next wave of ADA Title III litigation. The latest trend is ADA Title III litigation focused on hotel web sites and this type of litigation combines elements of past ADA Title III litigation in that it deals with the physical space at the hotel (ADA accessible rooms) as well as how those rooms are described on the hotel’s reservation system and how the rooms are reserved and held for guests…

April 24, 2018 | Source: Brooklyn Daily Eagle
Junior’s, the internationally known cheesecake maker and fixture on Flatbush Avenue for decades, discriminates against blind people by building a website that is intentionally inaccessible to the visually impaired, a new lawsuit charges. Brian Fischler, who is legally blind, is seeking unspecified damages from the 67-year-old Downtown Brooklyn restaurant and demanding that it fix its website, www.juniorscheesecake.com, so that visually impaired people can navigate it, order online, view menus and take advantage of pop ups that advertise best sellers and “cheesecake giveaways.”…

The Gaming Industry is Susceptible to ADA Website Accessibility Lawsuits
April 24, 2018 | Source: JD Supra
While we usually think that that the Americans with Disabilities Act (“ADA”) is limited to physical barriers impacting disabled individuals, such as whether doorways are wide enough or ramps too steep, lawyers for disabled individuals are making a concerted effort to expand this doctrine to include websites and mobile apps. In fact, the filing of lawsuits against companies for purportedly inaccessible websites is one of the fastest-growing trends in consumer protection litigation, and the gaming industry is a target…

MTA Approves Spending $600 Million to Ease Access for Disabled
April 25, 2018 | Source: Bloomberg & MTA
There’s only one bank of ticket machines at the Hartsdale train station, all on the southbound side. That’s not an issue for most northbound passengers: Grab a ticket, then cross the pedestrian bridge linking the two Harlem Line platforms. It’s more difficult if you’re in a wheelchair. “It’s really simple things. It’s common sense stuff,” said Michael Hellmann, the Americans with Disabilities Act specialist at the Westchester Independent Living Center, himself a part-time wheelchair user. “How about signs? How about ticket machines? How about smooth pavement?”…

They were people with a range of visual impairments, from macular degeneration to complete blindness. And Cheng wanted to see how well they could use the app…

This Little Boy’s Response To A Target Ad Shows The Power Of Representation
April 26, 2018 | Source: Huffington Post
One mom is thanking Target for an awesome reason. Jamie Sumner and her 6-year-old son, Charlie, walked into Target last week to get some coffee and peruse the dollar bin aisles. Their mundane shopping trip turned rather profound when Charlie, who has cerebral palsy and uses a wheelchair, saw an advertisement in the kids’ clothing section that made him smile and sign for “more.” The advertisement portrays a young boy around Charlie’s age wearing a hat and sweater and laughing. Nothing seemed very out of the ordinary until Sumner saw that the boy in the ad was using a walker…
